This agreement is between T3R, trading as MailPuck ("we", "us"), and you, the person installing or running MailPuck.
MailPuck is a local macOS menu-bar utility that works with your own Apple Mail installation to read messages, generate draft replies using an AI model, and place those drafts back into Apple Mail. MailPuck never sends email on your behalf. Every draft waits for you to review and send it yourself.
MailPuck currently runs on a "bring your own key" model: the app talks directly to your chosen AI provider from your own Mac, with no MailPuck server in between reading or routing your email content.
You must be at least 18 and able to enter a binding contract. If you are agreeing on behalf of an organisation, you confirm you have authority to do so.
To generate drafts, MailPuck needs an API key you obtain directly from an AI provider (currently Google Gemini). That key, and your relationship with that provider, is between you and them.
Data handling varies by provider tier. Providers commonly apply different data-retention and model-training rules to free-tier versus paid-tier use. Under some free tiers, your prompts and email content may be used to improve that provider's models. This is the provider's policy, not ours. Please check their current terms before choosing a tier.
You are responsible for your own compliance with your provider's terms, and for any billing charges, rate limits, or account issues arising from your use of them.
As of this version, only Google Gemini is functionally wired into MailPuck. Other providers may appear selectable in Settings for future use and will not generate drafts until support is genuinely live.
If you connect MailPuck to an email account issued to you by an employer, educational institution, or any other organisation, you confirm that:
We take no responsibility for consequences you face from your own organisation as a result of connecting an account you were not authorised to connect.
You are the data controller, or authorised processor, for any personal or sensitive data processed through MailPuck. You agree not to transmit email content to a third-party AI provider in a way that breaches the UK Data Protection Act 2018, UK GDPR, EU GDPR, or any other privacy law applicable to that data.
MailPuck creates drafts only. You are solely responsible for reviewing the accuracy, appropriateness, and tone of any draft before you send it.
You will not reverse engineer, decompile, or disassemble MailPuck except where law prevents that restriction; resell, rent, sub-licence, or redistribute MailPuck as a service; or use MailPuck to generate spam, harassment, or unlawful correspondence.
After an initial trial period, MailPuck offers a free baseline tier and paid weekly subscription tiers as described in the app. Pricing and drafting limits are shown in Settings and may change on notice.
Paid subscriptions are billed weekly in advance through our payment processor and auto-renew until cancelled. Your payment method is retained by that processor for renewal, in line with their standard terms.
You may cancel at any time from within the app or through your payment processor account. Access typically continues to the end of the current billing period, then drops to the free baseline tier.
Website account and access recovery. You can also manage your subscription through a MailPuck website account, separate from the Mac app, so your subscription survives losing access to a particular Mac. This account uses passwordless sign-in: we email you a link rather than asking for a password. Because there is deliberately no password, if you lose access to the email address tied to your account, restoring access requires us to verify your identity manually. We are not responsible for delays in that manual process.
Your statutory cancellation right. If you are a UK consumer, you ordinarily have a 14-day right to cancel a contract for digital services and receive a refund. Because a paid tier grants immediate additional drafting capacity, by subscribing you expressly request immediate performance and acknowledge that you lose that 14-day cancellation right once the paid tier becomes active, under Regulation 37 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing here affects statutory rights that cannot be excluded by agreement.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and run MailPuck on Apple-branded devices you own or control. We retain all title, copyright, and intellectual property rights in MailPuck.
MailPuck runs locally on your Mac. Your API key, email content, prompts, and generated drafts are processed on your device and sent directly from your device to your chosen AI provider over an encrypted connection.
We do not operate a proxy or middle-man server for your mail traffic in this version, do not retain central copies of your correspondence, and do not sell your data. We do operate a small backend used only for account entitlement checks, in-app feedback, crash reports, and update checks. It never routes or reads your email content or AI prompts.
A separate, future hosted version of the product may route drafting through our own backend instead of your own key. That would be a distinct product with its own privacy notice and terms, and this agreement should not be assumed to cover it.
MailPuck is provided "as is" and "as available", to the maximum extent permitted by law.
If you are a UK consumer, nothing here excludes statutory rights that cannot be waived, including that digital content must be of satisfactory quality and fit for purpose. However, we cannot warrant that AI-generated drafts will be factually accurate, appropriately toned, or free of errors, or that MailPuck will remain compatible with future versions of macOS, Apple Mail, or third-party AI provider APIs.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under UK law.
Subject to that, we are not liable for disciplinary or employment consequences imposed on you by your employer or institution; regulatory fines or data-breach consequences arising from your own transmission of data; loss of profit, business, or goodwill; or data loss or exposure caused by third-party providers or your own device's vulnerabilities.
Subject to the above, our total liability under this agreement is capped at the greater of the amount you paid us in the 12 months before the claim, or £50.
You agree to indemnify us against claims arising from your breach of this agreement, your breach of any workplace or institutional policy, your infringement of third-party rights, or any claim brought against us by your employer, institution, or a data subject arising from your use of the app.
You may terminate at any time by deleting the app and revoking your stored API key.
We may suspend or terminate your licence, and revoke or cancel your subscription, without notice, if you breach this agreement, use the app for abuse or unlawful activity, or engage in payment fraud or chargeback abuse. Where a paid subscription is cancelled for cause, we are not obliged to refund the remaining period.
MailPuck may update automatically. We may update this agreement from time to time, and material changes will be flagged in the app before they take effect. Continued use after a material change constitutes acceptance.
This agreement is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. UK and EU consumers resident elsewhere may bring proceedings in their local court under applicable consumer protection law.
If any clause is found unenforceable, the rest remains in effect. This is the entire agreement between you and us regarding MailPuck.
